The man\u00adu\u00adfac\u00adtur\u00ader\u2019s war\u00adran\u00adty is sub\u00adject to the man\u00adu\u00adfac\u00adtur\u00ader\u2019s terms. All war\u00adran\u00adty claims for defects and legal war\u00adran\u00adty claims against AAA are waived. Except for dam\u00adage caused inten\u00adtion\u00adal\u00adly or through gross neg\u00adli\u00adgence, any lia\u00adbil\u00adi\u00adty of AAA, includ\u00ading lia\u00adbil\u00adi\u00adty for aux\u00adil\u00adiary per\u00adsons (Art. 101 OR), is exclud\u00aded. The cus\u00adtomer is advised that car\u00adry\u00ading out ser\u00advice work accord\u00ading to the ser\u00advice book is a pre\u00adreq\u00adui\u00adsite for claim\u00ading the man\u00adu\u00adfac\u00adtur\u00ader\u2019s war\u00adran\u00adty.    <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">General<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Addi\u00adtion\u00adal assur\u00adances or agree\u00adments sup\u00adple\u00adment\u00ading this con\u00adtract are only valid if con\u00adfirmed in writ\u00ading by AAA.<\/li>\n\n\n\n<li>The pur\u00adchased vehi\u00adcle remains the prop\u00ader\u00adty of AAA until the pur\u00adchase price has been paid in full. Ben\u00ade\u00adfits and risks trans\u00adfer to the cus\u00adtomer upon con\u00adclu\u00adsion of the pur\u00adchase con\u00adtract. <\/li>\n\n\n\n<li>The cus\u00adtomer is oblig\u00adat\u00aded to con\u00adtin\u00adue main\u00adtain\u00ading and car\u00ading for the vehi\u00adcle giv\u00aden in pay\u00adment until tak\u00ading deliv\u00adery of the pur\u00adchased vehi\u00adcle. Oth\u00ader\u00adwise, AAA is enti\u00adtled to demand a high\u00ader resid\u00adual pur\u00adchase price than agreed. <\/li>\n\n\n\n<li>Com\u00adpli\u00adance with offi\u00adcial reg\u00adu\u00adla\u00adtions, such as obtain\u00ading type approval or car\u00adry\u00ading out a can\u00adton\u00adal motor vehi\u00adcle inspec\u00adtion for Swiss reg\u00adis\u00adtra\u00adtion, may lead to deliv\u00adery delays beyond AAA\u2019s con\u00adtrol. If the deliv\u00adery date agreed on page 1 of the con\u00adtract can\u00adnot be met, AAA will be in default at the ear\u00adli\u00adest after eight weeks have elapsed. In this case, the cus\u00adtomer may set AAA a grace peri\u00adod of at least four weeks. Any lia\u00adbil\u00adi\u00adty of AAA for default is exclud\u00aded.   <\/li>\n\n\n\n<li>In the event of any defects in the vehi\u00adcle pur\u00adchased by the cus\u00adtomer, price reduc\u00adtion and rescis\u00adsion are exclud\u00aded. Off\u00adset\u00adting coun\u00adter\u00adclaims against the pur\u00adchase price is exclud\u00aded. <\/li>\n\n\n\n<li>If the pur\u00adchased vehi\u00adcle is equipped with a nav\u00adi\u00adga\u00adtion device, a cor\u00adre\u00adspond\u00ading data car\u00adri\u00ader is not part of the equip\u00adment. Any spare keys avail\u00adable will be sup\u00adplied. <\/li>\n\n\n\n<li>Direct\u00adly import\u00aded vehi\u00adcles may dif\u00adfer from vehi\u00adcles import\u00aded by the gen\u00ader\u00adal importer in terms of equip\u00adment, engine, and man\u00adu\u00adfac\u00adtur\u00ader\u2019s war\u00adran\u00adty.<\/li>\n\n\n\n<li>By agree\u00ading to TCS mem\u00adber\u00adship, a war\u00adran\u00adty exten\u00adsion, or an insur\u00adance offer, the buy\u00ader con\u00adsents to the for\u00adward\u00ading of the nec\u00ades\u00adsary data to the respec\u00adtive ser\u00advice providers. Inso\u00adfar as the pro\u00adcess\u00ading or ver\u00adi\u00adfi\u00adca\u00adtion of these third-par\u00adty ser\u00advices requires it, the buy\u00ader agrees to AAA receiv\u00ading the con\u00adtract doc\u00adu\u00adments pre\u00adpared by these ser\u00advice providers. AAA does not pro\u00advide sub\u00adstan\u00adtive advice on the prod\u00aducts of these ser\u00advice providers and excludes any lia\u00adbil\u00adi\u00adty in this regard.  <\/li>\n\n\n\n<li>In the event of non-per\u00adfor\u00admance or improp\u00ader per\u00adfor\u00admance of this con\u00adtract by the buy\u00ader, a con\u00adtrac\u00adtu\u00adal penal\u00adty of 20% of the pur\u00adchase price for the pur\u00adchased vehi\u00adcle is agreed. How\u00adev\u00ader, AAA may also demand per\u00adfor\u00admance of the con\u00adtract or claim dam\u00adages exceed\u00ading the con\u00adtrac\u00adtu\u00adal penal\u00adty. If the trade-in vehi\u00adcle to be trans\u00adferred accord\u00ading to the pur\u00adchase con\u00adtract is not hand\u00aded over to AAA upon deliv\u00adery of the pur\u00adchased vehi\u00adcle, a con\u00adtrac\u00adtu\u00adal penal\u00adty of CHF 2,000 is owed. In this case as well, AAA remains enti\u00adtled to demand prop\u00ader per\u00adfor\u00admance of the con\u00adtract or to claim dam\u00adages exceed\u00ading the con\u00adtrac\u00adtu\u00adal penal\u00adty.   <\/li>\n\n\n\n<li>Place of per\u00adfor\u00admance for all oblig\u00ada\u00adtions under this con\u00adtract is Z\u00fcrich\u00adstrasse 47, 8607 Aathal. <strong>Place of juris\u00addic\u00adtion is 8340 Hinwil\/ZH.<\/strong><\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">Payment Terms \/ Vehicle Delivery<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li>You can pick up your pur\u00adchased vehi\u00adcle from us after mak\u00ading an appoint\u00adment by phone. Please call your per\u00adson\u00adal cus\u00adtomer advi\u00adsor at least four work\u00ading days before the sched\u00aduled time and arrange the pick\u00adup appoint\u00adment with them. Vehi\u00adcle deliv\u00ader\u00adies (only in the pres\u00adence of your per\u00adson\u00adal cus\u00adtomer advi\u00adsor) Mon\u00adday to Fri\u00adday 9:00 AM\u201311:30 AM and 1:30 PM\u20136:30 PM.
